These Terms and Conditions govern your use of the Winclub Giveaway website and your participation in any competitions operated by Winclub Giveaway Ltd. By using this website or entering any competition, you agree to be bound by these terms in full. If you do not agree, you must not use this website or enter any competition.

1. Definitions

In these Terms and Conditions:

  • "Company", "we", "us", "our" refers to Winclub Giveaway Ltd, Company Number 17089174, registered in England and Wales.
  • "Website" refers to winclubgiveaway.com and all associated subdomains.
  • "Competition" refers to any prize draw or prize competition listed on the Website.
  • "Entrant", "you", "your" refers to any individual who enters a Competition.
  • "Ticket" refers to a numbered entry into a Competition.
  • "Draw" refers to the process by which a winning Ticket number is selected.

2. Eligibility

To enter any Competition on Winclub Giveaway, you must:

  • Be at least 18 years of age at the time of entry.
  • Be a resident of the United Kingdom, unless otherwise stated on the specific Competition page.
  • Not be an employee, director, or immediate family member of any employee or director of Winclub Giveaway Ltd.

We reserve the right to request photographic identification or proof of age at any time. Failure to provide satisfactory proof within 7 days of a request may result in disqualification and forfeiture of any prize.

3. How to Enter

To enter a Competition, you must:

  1. Visit the Competition page on our Website.
  2. Correctly answer the qualifying skill-based question displayed on the page.
  3. Select the number of Tickets you wish to purchase.
  4. Complete the checkout process and make payment.

Upon successful payment, you will be assigned unique, randomly generated Ticket number(s) from the remaining pool for that Competition. Your Ticket number(s) will be displayed in your account (if registered) and sent to you via email confirmation.

4. Ticket Pricing and Early Bird Offers

All Ticket prices are displayed in GBP (£) and include VAT where applicable. Each Competition page clearly states the Ticket price and the total number of Tickets available.

Early bird pricing may be offered for a limited period after a Competition launches or for a limited number of Tickets (e.g., the first 20% of Tickets sold). After the early bird allocation is exhausted or the early bird period expires, standard pricing applies. Early bird availability is displayed on the Competition page and is subject to change without notice.

5. Account Registration

You may create an account on our Website to track your entries, view your Ticket numbers, manage your personal details, earn cashback rewards, and participate in our referral programme.

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect any unauthorised use of your account. We are not liable for any loss arising from unauthorised access to your account caused by your failure to safeguard your login details.

6. Guest Checkout

You are not required to create an account to enter a Competition. Guest checkout is available by providing your full name, email address, and billing information. Guest entrants receive Ticket confirmations and winner notifications via the email address provided at checkout. To access additional features such as cashback and referrals, account registration is required.

7. The Draw

All Draws are conducted live on our official Facebook page and YouTube channel. The winning Ticket number is selected using Google's random number generator (RNG) during the live broadcast. This process ensures full transparency and fairness.

The scheduled Draw date for each Competition is displayed on the Competition page. If all Tickets sell out before the scheduled date, the Draw may be brought forward with at least 24 hours' notice published on our Website and social media channels.

In the event of a technical failure during a live Draw, we will reschedule the Draw within 48 hours and announce the new time on our social media channels.

8. Draw Extension and the 80% Rule

If fewer than 80% of the total available Tickets have been sold by the scheduled Draw date, Winclub Giveaway reserves the right to:

  • Extend the Draw date by up to 14 days (and repeat this extension if necessary).
  • Reduce the total number of available Tickets to match the number sold, thereby bringing the Competition to a close.
  • Offer an alternative cash prize of lesser value than the original advertised prize, proportionate to the number of Tickets sold.
  • Cancel the Competition entirely and issue full refunds to all Ticket holders.

We will notify all Ticket holders via email of any material changes to a Competition, including date extensions or prize changes.

9. Winner Notification

The winner will be contacted via the email address associated with their entry within 48 hours of the Draw. Winners are also announced on our Facebook page, YouTube channel, Telegram community, and the Winners page on our Website (using first name and last initial only).

Winners must respond to our notification email within 30 days to claim their prize. If we do not receive a response within this period, the prize may be forfeited and a re-draw conducted at our sole discretion.

10. Cash Alternative

Where a cash alternative is offered, the amount will be clearly displayed on the Competition page. The winner may choose either the advertised prize or the cash alternative, but not both. The decision must be communicated to us within 7 days of confirming acceptance of the prize. If no preference is stated within this period, the physical prize will be awarded by default.

Cash alternative payments are made via bank transfer to a UK bank account within 14 working days of the winner providing their bank details.

11. Prize Delivery and Collection

Physical prizes (including vehicles) will be delivered to or made available for collection by the winner within 28 days of the winner claiming their prize, unless otherwise stated.

  • Vehicles: Winners may collect the vehicle from a mutually agreed location or request delivery to a UK mainland address. Delivery outside of UK mainland may incur additional charges payable by the winner.
  • Other physical prizes: UK mainland delivery is included at no extra cost. Delivery to Northern Ireland, Scottish Highlands, or international addresses may incur additional shipping costs.
  • Cash prizes: Paid via bank transfer within 14 working days of receiving the winner's bank details.

Risk in the prize passes to the winner upon delivery or collection. We recommend the winner arranges appropriate insurance for high-value prizes from the point of collection or delivery.

12. Vehicle Prizes

Where the prize is a vehicle, the following conditions apply:

  • The vehicle will be provided with a valid MOT (where applicable) and at least 3 months' road tax at the time of handover.
  • The winner is responsible for arranging their own insurance before taking possession of the vehicle.
  • Any modifications shown in promotional imagery are included unless otherwise stated on the Competition page.
  • Vehicles are provided in the condition described on the Competition page. We do not provide warranties beyond any manufacturer warranty that may still be in effect.

13. Refund Policy

Once a Ticket has been purchased and a Ticket number assigned, no refunds will be issued. This is because: (a) the random Ticket number has been permanently allocated from the pool, altering the probability for all other entrants; and (b) the digital service has been fully provided at the point of Ticket number assignment.

By completing a purchase, you acknowledge and agree that the digital content is delivered immediately and you waive your right to a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

In the event that a Competition is cancelled by us, a full refund of the Ticket purchase price will be issued to all Ticket holders within 14 working days via the original payment method.

14. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, video content, and software, is the property of Winclub Giveaway Ltd or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

15. Limitation of Liability

To the fullest extent permitted by law:

  • Winclub Giveaway Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in any Competition or the use of any prize.
  • Our total aggregate liability to you in connection with any Competition shall not exceed the total value of Tickets you purchased for that Competition.
  • We are not liable for any loss or damage caused by circumstances beyond our reasonable control, including but not limited to technical failures, postal delays, acts of God, or government restrictions.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

16. Indemnity

You agree to indemnify and hold harmless Winclub Giveaway Ltd, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your participation in any Competition, or your misuse of this Website.

17. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Website or participation in Competitions after changes are posted constitutes acceptance of the revised terms. Material changes affecting existing Ticket holders will be communicated via email.

18. Cancellation Rights

We reserve the right to cancel any Competition at any time before the Draw takes place. In the event of cancellation, all Ticket holders for that Competition will receive a full refund within 14 working days via the original payment method. We shall have no further liability beyond the refund of Ticket purchase prices.

19. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms, or any Competition, shall be subject to the exclusive jurisdiction of the courts of England and Wales.

20. Dispute Resolution

If you have a complaint or dispute regarding a Competition, please contact us at [email protected] in the first instance. We will endeavour to resolve any dispute informally within 14 days. If we are unable to reach a resolution, you may refer the matter to an approved Alternative Dispute Resolution (ADR) provider or the courts as set out above.

21. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.
